End User License Agreement – 90PlusGear

Please read carefully before clicking “Agree,” downloading, or using the 90PlusGear application.

1. Acceptance
By using the application, you agree to the terms of this agreement. If you do not agree, do not use the application. The application is licensed, not sold, for personal use in accordance with the terms described herein.

2. Definitions
Application: software provided by 90PlusGear.
Company: 90PlusGear.
Content: texts, images, or information made available in the application.
Device: computer, mobile phone, or tablet used to access the application.
Third-Party Services: third-party content or services accessed via the application.
You: user of the application.

3. License
You are granted a limited, personal, non-exclusive, and non-transferable license to use the application. Commercial use is prohibited.

4. Third-Party Services
The application may contain links to or services from third parties. 90PlusGear is not responsible for the accuracy, legality, or copyright of such services.

5. Term and Termination
This agreement remains in effect until terminated by you or 90PlusGear. The company may terminate it immediately in case of violation. Upon termination, you must uninstall the application.

6. Indemnification
You agree to indemnify 90PlusGear and its partners against any claims related to your use of the application or violation of this agreement.

7. No Warranties
The application is provided “as is,” without any guarantees of functionality or suitability.

8. Limitation of Liability
90PlusGear’s maximum liability is limited to the amount paid for the application or 100 USD if it is free. There is no liability for indirect or consequential damages.

9. Severability and Waiver
If any provision is deemed invalid, the remaining provisions will remain in effect. Failure to enforce a right does not waive the right to enforce it in the future.

10. Changes
90PlusGear may modify this agreement at any time. Significant changes will be notified 30 days in advance. Continued use of the application implies acceptance of the new terms.

11. Governing Law
This agreement is governed by the laws of Portugal, and your use may also be subject to other local or international laws.

12. Entire Agreement
This document constitutes the entire agreement between you and 90PlusGear, replacing any prior agreements related to the use of the application.
